Ontario prejudgment interest is simple interest under the Courts of Justice Act, ss. 127–130. For non-pecuniary damages in personal-injury actions the rate is 5% per year (Rule 53.10); for other damages it is the rate published for the quarter the proceeding began. The court has discretion under s. 130.
